Meamama Terms And Conditions



1. INTRODUCTION

www.meamama.co.za(“the Site”) enables registered users to shop online for clothing and accessories (“the Products”). Although visitors to the Site (“Users” or “you”) will be able to browse the Site and all Products on offer, only those Users who register online to become a Me-a-Mama member (“Member” or “you”) will be able to make purchases.

2.  LEGALLY BINDING CONTRACT

2.1 All Users, including Members and those Members who purchase any products on the Site (“Purchasers”) are bound by these terms and conditions (“T&C”) and by browsing or using the Site in any way, you hereby acknowledge that you have read, understood and accepted these T&C.
If you do not agree to these T&C, do not register with or continue to use the Site. Your registration and/or continued use of the Site will constitute acceptance of the T&C, unmodified by you.

2.2 To place an order with Me-a-Mama you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us.

3. PURCHASING PRODUCTS

3.1 As a Member, the Site will enable you to place electronic orders (“Order”) for one or more Products offered, for so long as such Products are still available and have not sold out.
A purchase agreement between you and Me-a-Mama (“Purchase”) only comes into effect if you electronically submit a properly completed Order for one or more Products in your shopping basket AND payment is either authorised or received by Me-a-Mama into its bank account, subject to stock of the Product concerned being available.

3.2  Products cannot be reserved for later purchase, and placing a Product in your shopping basket without completing the purchase does not constitute an Order for, or a Purchase of such Product. Consequently, prior to actual Purchase, Me-a-Mama may remove any Product from your shopping basket if stock of the Product is no longer available, or if 30 minutes has elapsed, and you cannot hold Me-a-Mama liable if any Product is not available when you attempt to complete the Purchase at a later stage.

3.3  The Product shall be paid for in full at the time of ordering by supplying us with your credit or debit card details from a credit or debit card company acceptable to us, which we require in order to process your Order. Alternatively, you may pay by any method that we have said is acceptable to us, but in any event we shall not be bound to supply the Product before we have received cleared funds in full.

3.4  You undertake that all details you provide to us for the purpose of purchasing the Product from us will be correct, that the credit or debit card, or account or other payment method which you use is your own and that there are sufficient funds or credit facilities to cover the cost of the Product. We reserve the right to obtain validation of your payment details before providing you with the Product.

3.5  When you submit an Order to the Site, you agree that you do so subject to these Terms and Conditions current at the date you submit your Order. You are responsible for reviewing the latest Terms and Conditions each time you submit your Order.

3.6 A Contract shall be formed and we shall be legally bound to supply the Product to you when we accept your Order. Acceptance shall take place when we expressly accept your Order by email to you, in the form of a document called a "Confirmation of Order" stating that we are accepting your Order. Our Confirmation of Order shall be deemed to come into effect when it has been dispatched by us. Without affecting your obligation to pay us earlier, we may send an invoice to you at any time after we have accepted your Order. Until the time when we accept your Order, we reserve the right to refuse to process your Order and you reserve the right to cancel your Order. If we or you have cancelled your Order before we have accepted it, then we will promptly refund any payment already made by you or your credit or debit card company to us for the order of the Product.

3.7 If you find that you have made a mistake with your Order after you have submitted it to the Site, please contact zuki@meamama.co.za immediately. We will do our best to accommodate any changes, however we cannot guarantee that we will be able to amend your Order in accordance with your instructions.

4.  AMOUNTS PAYABLE BY YOU

The price of each Product is displayed with the Product listing. In the event of a sale or special offer, the discounted price is displayed.

5.  PAYMENT OPTIONS

5.1   Purchases may currently be paid for by credit and debit cards

5.2   At the time of placing the Order, the transaction details are presented to the bank and an authorisation is obtained for the amount of the Order. If such authorisation is not obtained, the Order will be cancelled. If authorisation is obtained, payment is usually immediate.
You warrant that you are fully authorised to use the credit card supplied for purposes of paying for your Order and that this credit card has sufficient available funds to cover all of the costs incurred as a result of using the Services.

6. TERMINATION OF PURCHASES AND CANCELLATION OF ORDER

6.1 By Me-a-Mama:

We reserve the right, for purposes of preventing suspected fraud, to refuse to accept or process payment on any Order and/or to cancel any Purchase, in whole or in part, on notice to you. Me-a-Mama shall only be liable to refund monies already paid by you in respect of the cancelled portion of the Order.

6.2 By You:

You are entitled to cancel any Order/s or Purchase/s as provided for in our policy.

6.3 Please note that all goods bought on the Me-a-Mama Site will only be returnable via our approved couriers to our premises, during working hours.

7. DELIVERY

7.1 Place of Delivery:

Currently, Me-a-Mama only delivers Products FREE to major cities within the Republic of South Africa. As the Purchaser, you will be able to specify the place of delivery within South Africa, and the contact number(s) to be used in relation to the delivery, for each Order when you place such Order. Me-a-Mama delivers outside of South Africa at a standard courier cost - this cost is added to your bill. Remote areas within South Africa also carry a delivery surcharge of R100 as a minimum, depending on the difficulty of access.

Products will be delivered to the delivery address specified by you during the Order process and if nobody is at the address when the delivery is made, our courier will contact the mobile number you provided to us in the relevant Order and/or a notice of attempted delivery may be put through the letterbox. Our courier will attempt re-delivery one more time thereafter, but if delivery is again unsuccessful, it will be your responsibility to contact the courier company to either arrange that you collect the package from the courier’s nearest depot or to agree upon a new delivery date with the courier. If you have not contacted the courier within a reasonable time, then the package will be sent back to Me-a-Mama who will contact you via email to arrange a possible re-delivery at your expense.

7.2 Delivery time:
Unless otherwise stated to you prior to placing the Order to final confirmation thereof, the estimated shipping time for an order is between 3 and 7 working days from the date of your purchase, depending on the location of delivery.

7.3 Partial Delivery:
You will be informed of the partial delivery of an Order by e-mail. A second e-mail will be sent informing you of the delivery of the other Products ordered, if applicable.
In the event of a partial delivery, there will be a delivery note in the package summarising the Products which can be found inside it.

7.4 Delivery Made:
Each delivery is deemed to have been made once the Product has been handed over to an individual at your chosen delivery address, including when this is done by the courier, as recorded in the tracking system used by the courier.
It is your responsibility as Purchaser, to ensure that you check the package upon arrival.

7.5 Lost Packages:
If neither the depot nor the tracking system (in the "My Delivery" section) show any trace of the package, you must then get in touch with Me-a-Mama by way of email to zuki@meamama.co.za
If the package is found it will then be sent to the specified delivery address, following the normal procedure as set out in this clause 7.1 (i.e. delivery of the package or notice of attempted delivery).

If the package is declared to be lost, Me-a-Mama will notify the Purchaser and refund the Purchaser for the lost package (both the Product purchase price and any delivery charges).

7.6 Delivery of Incorrect Product:

If the incorrect Product is delivered to you by mistake (i.e. it is not the Product you Purchased), please do not remove the Product from its original packaging or try the Product on at all. Please contact Me-a-Mama on zuki@meamama.co.za so that we can resolve the mistake by arranging to collect such Product from you and deliver the correct Product to you, as quickly as possible

7.7 Late Delivery:

If a Product you have Purchased is not delivered within the agreed delivery period, as per Clause 7.2 above, you are entitled to cancel such Purchase on 7 days notice to Me-a-Mama. Any such cancellation must be done via email to zuki@meamama.co.za and you will be entitled to a full refund.

8 RETURNS POLICY

8.1 Stock Shortages:

Should a Product you have ordered be;

8.1.1 Temporarily unavailable, Me-a-Mama will notify you thereof as well as the anticipated delay in delivery and, unless you agree to wait for such longer period for delivery, or accept delivery of another product in its stead or a credit on your Me-a-Mama account,  Me-a-Mama will issue a full refund in respect of that Product to you within 30 days after such notice;

8.1.2 Permanently unavailable/out of stock, Me-a-Mama  will notify you and, unless you agree to accept another product in its stead or a credit on your Me-a-Mama account, Me-a-Mama will issue a full refund in respect of that Product to you within 30 days after such notice.

8.2 “Cooling Off”Period

You are entitled to cancel any Purchase concluded on this Site within 7 days after having received the Product and to obtain a full purchase price refund within 30 days thereafter. However, such Product must then be returned at your risk and expense and the product must be returned in a re-saleable condition in order to be entitled for a refund. Please therefore do not remove the Product from its original packaging and/or use or wear the Product.

8.3 Defective Products

If, after delivery of the Product to you, you find that the Product is defective/faulty or not reasonably durable  (“Defective”), you can arrange to return such product to Me-a-Mama for inspection (at Me-a-Mama’s expense).

8.3.1 If the Product is subsequently found to be Defective, you are entitled to either (a) be fully refunded, or (b) have the Product repaired or replaced at Me-a-Mama’s expense (the decision between repairing or replacing being that of Me-a-Mama’s depending on availability of stock)

8.3.2 If the Product is subsequently found to NOT be Defective, you will not be entitled to any repair, replacement or refund but will instead be liable for the costs incurred in having such Product returned to Me-a-Mama and then re-delivered to you.

8.3.3 The following are instances in which the Product will NOT be deemed to be Defective and will not entitle you to any refund, repair or replacement:

- Faults resulting from normal wear and tear.
- Damage arising from incorrect usage of the Product.
- Products not fitting you properly due to you not having measured yourself accurately in accordance with sizing guidelines
- The Product was on sale - if the garment was bought at a reduced price, on a sale, no returns are possible.

8.4 Return Procedure to be followed:

8.4.1 Using the invoice relevant to the Purchase of the Product you want to return as a reference, you must contact Me-a-Mama on zuki@meamama.co.za and book a return, stating the reason entitling such return under this Return Policy (i.e. you are ‘cooling off’ within 7 days, or the Product is Defective).

8.4.2 Me-a-Mama will then arrange for the collection of the Product from you, to be returned by secure courier.

8.4.3 You must ensure that the Product to be collected by the courier is packed by you to ensure that the Product is suitably protected with its original packaging and that it is still in perfect condition for the purposes of re-sale.

8.4.4 A non-Defective Product will not be accepted as a valid return if it clearly shows signs of having been subject to lasting use (longer than a few minutes). In other words the Products must not show marks of extended use beyond the time required to try them on and/or test them and must be in a condition allowing them to be resold.

9. PROCESSING OF CREDITS AND REFUNDS

Should you be entitled to a refund for any reason, such refund shall be effected on the credit card used to Purchase the Product. Where your account has been credited, you will be entitled to use such credit towards other purchases made by you on the Site.
